What happens when parties finally reach an agreement over a dispute? There is a lot to think about at this stage, in particular making the agreement stick. It is helpful to think early on about which approaches to implementation can and should be used. Who will need to be joined or represented in the compromise application and will Court approval be required? These are a few of the mechanisms which will be explored in this fascinating session.

Many offshore trust jurisdictions have firewall legislation designed to render orders made in other jurisdictions and forced heirship rights, unenforceable against trusts. Do these provisions actually work? Are certain provisions incomprehensible or ineffective when looked at closely? Are there any gaps that the enterprising litigator can exploit? In an unusual proceeding, involving advocates appearing before "Justice" Warnock-Smith (who may or may not be assisted by a very large jury), we will put firewall provisions on trial.
